SUMMARY: The article deals with the nature of the provisions of the EU Regulation 1215/2012 on jurisdiction in the part relating to insurance. The author is looking for an answer to the question whether national courts have jurisdiction in disputes when the plaintiff is the buyer of a claim for damages who is an entrepreneur purchasing such claims or repairing motor damage. The thesis of the article is the recognition that special jurisdiction in insurance disputes is exceptional and is aimed at protecting the weaker party in this legal relationship. The author does this with the help of an analysis of the jurisprudence of Polish and Lithuanian courts and preliminary questions from these courts. The previous jurisprudence of the CJEU also comes to the rescue, including the Lithuanian case ended with such a judgment. The article is an attempt to solve the problem using various methods of interpretation. In conclusion, the author presents a proposed solution, which is the rejection of the claim in the analysed Polish example. This is the more interesting position of the doctrine before the decision of the Tribunal.
