SUMMARY:

The article refers to problematic issues of prosecutor’s procedural supervision over pre-trial proceedings held in the form of an investigation. The author identifies the legal basis for such supervision as well as the methods and scope thereof. Material shortcomings of prosecutor’s supervision are listed, such as: no information to the prosecutor that an investigation was opened, the phenomenon of “travelling files” and deficits related to the possibility to impose discipline on the functionaries of investigating authorities by the prosecutor. Proposals are presented for appropriate legislative and organisational amendments to eliminate these shortcomings.
