SUMMARY:

The comments to the judgement of the Supreme Court of 25 June 2020, I KZP 4/20 approves the ruling specified therein that in the event of criminal proceedings related to an offence under § 1 or 1a Article 209 of the criminal code against one parent of the child, the minor’s rights may be exercised by the other parent. Criticism was focused on the statement that this is because “the legal actions taken by a representative of a harmed minor (child) in such proceedings are legal actions concerning, e.g. maintenance and upbringing funds due to the child from such parent, within the meaning of Article 98 § 2.2 of the Family and Guardianship Code”.
