SUMMARY: The paper addresses issues related to another major amendment to the Polish Code of Criminal Procedure, which has extended a possibility for the court of appeal to adjudicate on the merits of a case. Under the amendment, the court of second instance will be able to convict the perpetrator, against whom the proceedings have been conditionally discontinued, as well as to increase the punishment by imposing a life sentence. In view of the validity of such a solution, this issue is of particular importance and needs to be further clarified.
