SUMMARY: In a comment to the judgement of 10 May 2019, I CSK 207/18, the interpretation made by the Supreme Court was approved as related to the term “ownership transformation” specified in Art. 2 of the Act of 6 July 2001 on the preservation of the national nature of domestic strategic natural resources. In accordance with this interpretation natural resources defined in Art. 1 of the Act, owned by the State Treasury, that are not subject to ownership transformation, are subject to other regulations set forth in specific applicable laws. In the commentator’s opinion, the statement by the Supreme Court is correct and the provision of Art. 2 of the Act does not preclude the acquisitive prescription of a property of the State Treasury being a state forest within the meaning of Art. 1.3 of the Act, in compliance with Art. 172 et seq. of the Civil Code.
