SUMMARY:

In this paper, the author analyses aspects of apparent transactions and the use of their results in criminal proceedings. Use of the results is subject to multiple conditions, requires skilful verification of the multiple areas of operation by the institution authorised to perform such operations and often raises serious interpretation doubts in prosecutors’ and judges’ practical activities. This article tries to present details of the institution – not only as perceived in the light of interpretation of applicable regulations but also from the perspective of the essence of apparent transactions, apparently embedded in specific features of operational and investigative operations. A broader view of the procedural effects of shortcomings related to those issues, also subject to the provision of Art. 168a of the Criminal Procedure Code, will be presented in a future paper.
