SUMMARY:

The purpose of the article is to present – using the example of a telescopic truncheon – interpretational problems related to the feature of the subject of Art. 280 § 2 of the Penal Code, qualifying criminal liability on the basis of the object used by the perpetrator. The article refers to views of the doctrine and case law against a historic background and it is based on a case study of a practical application of such legal qualification on the basis of a case reviewed by the District Court in Katowice.
