SUMMARY:

The commented judgement of the Supreme Court was issued in a case concerning an entry into a land and mortgage register in civil proceedings. The Supreme Court passed the judgement having reviewed an appeal against a judgement of a district court refusing a cassation appeal. With its judgement the Supreme Court rejected the demand to cancel the appealed judgement. Justifying its judgement, the Supreme Court clarified the essence of the case relating to an entry in the land and mortgage register in civil proceedings. The focus by the Supreme Court on that issue results from the value accepted in the system of legal values which is the pursuance of safety of the legal environment. In order to achieve the above, it is inter alia to enter a warning into a land and mortgage register of pending civil proceedings.
