SUMMARY:

The subject of this study is the crime of aggression as introduced into the Statute of the International Criminal Court during the Kampala Review Conference. The interpretation and application of the new rules governing the definition of crime and the rules governing the jurisdiction of the Court will constitute another, somewhat new challenge for the International Criminal Court. The effects of the compromise worked out during the Review Conference raise numerous doubts to the present day, constituting a source of divergences in interpretation. There is no agreement on, among other things, the validity of the solutions adopted as regards the way in which the definition of the crime of aggression is formulated, and within its framework, the act of aggression, the rules of jurisdiction of the Court, the role of the Security Council and the scope of jurisdiction of the Court. The article discusses the most important issues and problems related to the introduction of the crime of aggression into the Statute and presents far-reaching discrepancies in the positions presented in the literature.
