In practice, abuses in this field are not uncommon. In his comment, the author approves the Supreme Court’s view that defining the type of work is of key importance both for the employment contract (the element defining this legal act) and for the employment relationship. This parameter determines the scope of the employee’s obligation and, in consequence, subjects the person performing the work to the management of the employer. According to the author, the lack of subordination in the performance of a specific job does not allow a specific legal connection to be classified as an employment relationship.
