Data publikacji: 2019-09-30 URL: https://www.kssip.gov.pl/pobierz_plik/2019-3_35_-_tajemnica.pdf SUMMARY: The article discusses the issue of journalistic secrets, the limits thereof and the reasons and scope of releasing journalists from their duty to keep in confidence information acquired in connection with practising their profession. The author analyses the provisions of penal and procedural laws and the press law, also referring to binding provisions of international law. The author looks at the function and need for existence of Art. 180 § 5 of the Penal Procedure Code in legal transactions. Further on, the author focuses on the offences of defamation made in the press known as media defamation. Stressing the significance of freedom of speech, the author states that the limit of a breach of the right of good name is imprecise – which is a right of material importance. In addition, the author discusses the indications of the offence of defamation and which circumstances exclude the unlawfulness of the offence.
