Data publikacji: 2019-09-30 URL: https://www.kssip.gov.pl/pobierz_plik/2019-3_35_-_zakres.pdf SUMMARY: This article discusses the subject coverage of the penal measure for a ban to enter a mass event, regulated in the Penal Code. The conditions to adjudicate such penal measure are clarified. Problematic aspects of the methods to adjudicate the measure are presented. The author presents his own opinion on the methods to identify mass events covered by the ban, their territorial coverage, identifying a simple ban on entry to a mass event to a comprehensive ban on entry to a mass event. In particular, the author tries to clarify the notion of a football match as a specific type of mass event and the notion of staying and being present at a specific place, within the meaning of Art. 41b of the Penal Code.
