A last will is the right of every person with full legal capacity; however, life experience shows that it is not always the case that the person making their last will is fully aware of the significance and effects of the legal act. This application focused on the interpretation and normative significance of Art. 945 of the Civil Code regulating reasons for declaring a last will as invalid. The author presents the premises set forth by the legislator, relying on judgements and views expressed in the doctrine. The author in particular focuses on procedural and evidential presentation aspects related to court proceedings, noting hypothetical situations and difficulties that may arise in proceedings, assessing them from the viewpoint of parties to the proceedings or professional representatives.
