SUMMARY:

The presented judgement relates to assessment criteria of the quantity of drugs as a material quantity within the meaning of the Act on counteraction to drug addiction. In that context, the comment presents the history of previous judgements of the Supreme Court in that respect, the objections they raised and stresses those elements of the judgement that are a novelty in the sphere, applying additional assessment criteria in the subject. Afterwards, the author criticises certain arguments presented by the Supreme Court specifying that a majority of the additional assessment criteria of the quantity of drugs as material, offered by the Supreme Court, are not rooted in the Act. The comment contains a standpoint in accordance with which types of drug-related offences qualified on the basis of material quantities of drugs, were based solely on the quantity criterion while the aspects related to the type of drug, the extent of relationship of the offence and the drugs and the objective of possessing the drugs, are indifferent from the viewpoint of the findings as to the materialisation of the qualifying indication while they may be of importance to assess an act as of minor significance.
