SUMMARY:

The Act of 17 June 2004 in complaints on breach of the right of a party to review the case in preparatory proceedings carried out or supervised by a public prosecutor and in court proceedings without unjustified delay (hereinafter the Act) regulates the principles and mode of filing and reviewing complaints of a party whose right to review the case without unjustified delay as a result of actions or failure to act by a court or public prosecutor carrying out or supervising preparatory proceedings (Art. 1.1 of the Act). The right to have a case reviewed without unjustified delay falls within the right to fair trial as specified in Art. 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Art. 14.1 of the International Covenant on Civil and Political Rights. Pursuant to Art. 45.1 of Poland’s Constitution, every person has the right to a fair and open review of their case without unjustified delay by a competent, impartial and independent court. The objective of the article is to present the results of an analysis of application of the Act in the most frequent procedural situations, with a special focus on judgements of lower instance courts.
