Art 29 § 2 of the Labour Code provides that employment contracts shall be made in writing, as specified in Art. 78 § 1 of the Labour Code. Failure to make a written employment contract when concluded does not result in the contract being invalid or ineffective. Additionally, failure to confirm to employees in writing – pursuant to Art. 29 § 2 second sentence of the Labour Code – of the contractual terms and conditions at the latest on the day the employee is permitted to commence work, does not invalidate the activity in terms of labour law. In the author’s opinion, employment contracts may also be concluded implicitly (by way of conclusive behaviour of both parties). It is also possible that both parties to the employment contract make compliant declarations of intent modifying or terminating the contract.
