Not only are public institutions victims to such offences but also society at large is affected by the consequences of defectively selected bids. The judgement notes very important elements resulting in criminal liability for offences related to tenders – the definition of the notion of acting to the detriment of the tender organiser and the public nature of tenders. In effect, this has an impact on the protection limits of public tenders by penal law.
