It is the „high probability of committing a crime” (Article 249 § 1 of the Code of Criminal Procedure). Such a high level of probability of perpetration is justified by the degree of severity of the procedural measure we are interested in. Its determination must take into account the indications resulting from the content of Art. 92 of the Code of Criminal Procedure stating, that the basis for a decision may consist only of all the circumstances disclosed in the proceedings, which are relevant to the decision, and should respect the principle of free evaluation of evidence (Article 7 of the Code of Criminal Procedure). The text points out that the court, when considering a request to apply (extend) pre-trial detention in the preparatory proceedings, is not restricted by the description of the criminal act and its legal qualification indicated in the decision on the presentation of charges. It must, of course, take into account the content of the historical event that forms the basis for the issuance of this decision. Similarly, in jurisdictional proceedings, the court deciding whether to apply (extend) pre-trial detention is only bound by the objective framework of the trial set out by the main complaint. At the end, it was emphasized that the necessity to establish a high probability of committing a crime and the ongoing monitoring of the degree of such probability by the court is not only a matter of fulfilling the relevant requirement of the Code, but also the implementation of the constitutional and conventional standard relating to the sphere of personal freedom of a human being.
