In the author’s opinion, in the current legal situation, a copy of the injunction sentence in misdemeanor cases should always be delivered to the aggrieved party, who may submit, within 7 days from the delivery of the judgment, not later than simultaneously with the objection to the injunction, a declaration that he will act as an auxiliary prosecutor. The amendment to the Code of Criminal Procedure of July 19, 2019 introduced a general obligation to deliver a copy of the injunction to each injured party, and also applies to the writ proceedings in misdemeanor cases. As a consequence, a special procedure for obtaining the status of an auxiliary prosecutor is provided for.
