URL: https://www.kssip.gov.pl/pobierz_plik/5_klak.pdf SUMMARY: The author, based on the jurisprudence of the Supreme Court, the Supreme Administrative Court and common courts, analyzes the essence and nature of the proceedings on a complaint regarding excessive length of proceedings within the meaning of the Act of 17 June 2004 on a complaint for violation of the right of a party to hear a case in preparatory proceedings conducted or supervised by the prosecutor and court proceedings without undue delay. The author draws attention to the incidental nature of the proceedings triggered by the lodging of the complaint, its inconsistency, as well as the ad hoc and interventional nature. The author also points to its controlling and supervisory character, with the simultaneous impossibility of appealing against the judgment issued as a result of examining the complaint.
