URL: https://www.kssip.gov.pl/pobierz_plik/7_kluza.pdf SUMMARY: The gloss concerns the Supreme Court’s ruling, in which the issue of the possibility of considering the accused’s motion for a conviction without a hearing (Article 387 § 1 of the CCP), submitted in the absence of the prosecutor, was discussed. The appellate court examining the prosecutor’s appeal against the judgment issued under this procedure had doubts as to whether the proceedings of the Court of first instance, which did not notify the prosecutor’s request, were correct. The Supreme Court took an unequivocally critical position as to the postulates, also expressed by the Public Prosecutor of the National Public Prosecutor’s Office, in view of the practice of making the application dependent on the position of the public prosecutor who did not participate in the hearing in the case.
