URL: www.kssip.gov.pl/pobierz_plik/7_kukula SUMMARY: Managing a criminal group is an important element of the functioning of organized crime, which translates into an increased risk of criminal punishment. There is no statutory definition of a criminal group and a criminal relationship in the Polish Penal Code, so the burden of interpreting these features of a crime has been taken over by the judicature of the courts. Over the course of several years, it has been possible to efficiently build a juridical definition of both organized crime structures and the related management of these structures. The person in charge is both a person who, in the form of a single authority, issues orders to members of a criminal group, but also persons reporting to a higher-ranking manager, who have a certain margin of discretion in making decisions, managing smaller and hierarchically subordinate field structures of such an organization.
