SUMMARY:

The article concerns the legal nature of the decision of the President of the Republic of Poland on the appointment to the office of a judge. From the point of view of current situation it appears to be a significant matter for representatives of science and practitioners of law. The regulation contained in art. 179 of the Constitution of the Republic of Poland expresses the essence of the decision of the President of the Republic of Poland, which established a nominating system for the appointment of judges by the executive body, which constitutes its indisputable personal right. The author of this article focuses on the constitutional powers of the President of the Republic of Poland in relation to the judiciary, and above all on the prerogative of appointing judges, which is the basis for issuing the act of appointment.The author’s assessment allows to put forward the thesis that the legal nature of the decision of the President of the Republic of Poland on the appointment to the office of judge determines that it is effective regardless of any possible defects in the nomination procedure and is not possible to change, control or verification decisions of the President of the Republic of Poland.
