SUMMARY:

The article addresses the issue of the crime of accepting a murder by order, introduced into the Polish legal system by the amendment to the criminal law of July 7, 2022. The commented provision arouses a number of controversies in the legal community, first of all, related to the sense of criminalization of behavior on planes very distant from the occurrence of the effect in the form of death of a human being and the potential violation of the fundamental principles of criminal law related to the criminalization of this type of behavior. The purpose of this paper is to carry out a dogmatic analysis of Article 148a § 1 and 2 of the Criminal Code, to draw attention to a number of systemic inaccuracies that arose after the introduction of this provision, as well as to answer the question of whether the shifting of the boundaries to such a distant foreground of the violation of a legal good is justified from the point of view of penal rationalism.
